Ordinance Governing the Use of Archival Documents at the Bundesarchiv (German Federal Archives)

§ 1

Right of Use

Archival documents at the Bundesarchiv may be used by everybody upon request in accordance with the regulations of the German Law on the Preservation and Use of Federal Archival Documents (Bundesarchivgesetz) and this ordinance.

§ 2

Type of Use

(1) Archival documents are made available for use in the original or as copies, or handed out as copies, or information about its content is provided. The decision pertaining to the actual type of use is at the discretion of the Bundesarchiv.

(2) As a rule, original archival documents are made available only on the premises of the Bundesarchiv. Decisions on exceptions are at the discretion of the President.

§ 3

Prerequisites for Use

(1) The user's request shall be submitted in writing including detailed information about the subject and the purpose of the research.

(2) The decision on the use request shall be made by the Bundesarchiv. Permission may be granted subject to certain conditions.

(3) Upon the Bundesarchiv's request, the applicant shall commit himself or herself in writing to observe privacy rights and copyrights as well as interests of third parties warranting protection when using research findings derived from archival documents, and to hold the Bundesarchiv harmless in case of any violation.

(4) Assistance to be provided by auxiliary staff within the scope of use will have to be specifically requested. The names of the auxiliary staff are to be stated in the user's request; para. 3 shall apply accordingly.

(5) In case findings derived from the archival documents are to be used for other subjects or purposes than those stated in the user's request, a new request will be required.

§ 4

User's Obligations

The user shall be obliged to leave the archival documents in the reading room, to maintain the internal order of the archival documents, to keep them undamaged, unchanged and in their current state of preservation.

§ 5

Suspension of User's Rights

If a user heavily violates the regulations of the Law on the Preservation and Use of German Federal Archival Documents or the statutory orders legislated in accordance with § 6 of the Law on the Preservation and Use of Federal Archival Documents (Bundesarchivgesetz), he or she shall be denied the right of access to the Bundesarchiv. 

§ 6

Use by German Federal Agencies

Any one of the agencies designated in § 2 (1) Clause 1 of the German Law on the Preservation and Use of Federal Archival Documents (Bundesarchivgesetz) or in § 1 (2) and § 2 of the Law Governing the Central Archiving of Documents from the domain of the law governing the legislation on the compensation of warinduced losses of 6th January 1988 (German Federal Law Gazette (BGBl) I p. 65) may use at any time the archival Documents which have developed in its purview or in the purview of its legal predecessor for the purposes of use authorized for these documents prior to their transfer to the Bundesarchiv. In this respect, §§ 1 through 5 of this ordinance shall not apply.

§ 7

(Entry into Force)
